A business owner in his 60s has been given a suspended sentence for causing the death of a 4-year-old girl due to negligence in controlling access to an outdoor adult swimming pool at a pool villa.

According to legal sources on the 31st, Judge Kang Seong-young of the 8th Criminal Division of the Incheon District Court sentenced A (69), who was indicted on charges of occupational negligence resulting in death, to 10 months in prison, suspended for two years.

A was indicted on charges of failing to maintain safety management at a pool villa in Ongjin-gun, Incheon, around 12:38 PM on June 11 last year, which led to the death of 4-year-old B, who fell into the adult pool while staying there.

B entered the pool alone and drowned; she passed away on July 18 last year due to brain damage while receiving hospital treatment.

The investigation revealed that the pool villa had both a children's pool and an adult pool installed outdoors for guests to use.

However, there were no access control devices, such as safety fences or gates, between the adult and children's pools, and no lifeguards were stationed.

The court stated that the sentencing took into account that the defendant admitted to the crime and that the pool villa management reached a settlement with the victim's parents, who no longer wish for punishment.
